THE
BMEXPRESS MONEY REMITTANCE SERVICE
A
BMExpress Money Remitance Service customer (the "Sender")
may send Money to a designated receiver (the "Receiver")
anywhere in the Philippines over the Internet using a credit
card (the "Service"). Money Remittance Service will
normally be paid to the Receiver in cash, check or a combination
thereof, subject to currency availability and the conditions
applicable to the selected payment locatiions. In this case,
all payments will be in Philippine Peso. Money sent via BMExpress
Money Remittance Service are delivered to the Receiver promptly
after validation of Sender information which may take between
12 to 24 hours. Remittances that exceed certain principal
amounts, and/or transfers to certain destinations may take
longer or be subject to additional restrictions. BMExpress
reserves the right to limit the principal amount of a Money
Remittance, or to reject a proposed Money Remittance, in its
sole discretion. Please contact BMExpress at the Customer
Service telephone number listed below for current information
regarding the conditions applicable to the service you have
selected or your expected payment location. When required
by applicable law, Money Remittances will be reported to federal,
state, local or foreign authorities. You will be required
to provide BMExpress with certain information to allow us,
among other things: to verify your identity; to receive appropriate
credit card authorization; and to complete the transaction.

FEES,
PAYMENT AND CURRENCY EXCHANGE
In
consideration for the use of the Service, you agree to pay
to BMExpress a fee for each Money Remittance initiated by
you at the applicable rate then in effect (the "remittance
fee"). The applicable remittance fee for your transaction
will be provided to you prior to your final authorization
of the transaction, in addition to any applicable fees for
additional services.

Currency Exchange
All
payments will be made in the Philippine Peso currency. In
addition to the remittance fees applicable to this transaction,
a currency exchange rate will be applied. The remitters
currency is converted to Philippine Peso at an exchange rate
set by BMExpress. Any difference between the rate given to
customers and the rate received by BMExpress will be kept
by BMExpress (and, in some cases, its international agents)
in addition to the remittance fees.
Payment,
Remittance fees and the principal amount are due and payable
before BMExpress processes the transaction. You must pay for
the Service by bank (credit or debit) card. If BMExpress does
not receive authorization from the card issuer, the transaction
will be not be processed and funds will not be transmitted
to the Receiver. Each time you use the Service you agree that
BMExpress is authorized to charge your designated card account
for the principal amount, the remittance fee and any other
applicable fees. (Your agreement with your card issuer governs
use of your card, and you must refer to that agreement to
ascertain your rights and liabilities as a cardholder, which
may include a "cash advance" fee.)

Refunds
Refunds
of Principal Amount and cancellation of the Money Remittance
will be made upon written request of the Sender if payment
to the Receiver has not yet been made at the time the request
is processed by BMExpress. REFUNDS OF FEES will be made upon
written request of the Sender if the Money Remittance is not
available to the Receiver within the time specified by BMExpress
for the selected service. Refunds will be made within 30 days
of receipt of a valid written request from the Sender.

Right to Refund
"You,
the customer, are entitled to a refund of the money to be
transmitted as the result of this agreement if BMExpress does
not forward the money received from you within 10 days of
the date of its receipt, or does not give instructions committing
an equivalent amount of money to the person designated by
you within 10 days of the date of the receipt of the funds
from you unless otherwise instructed by you.
If
your instructions as to when the moneys shall be forwarded
or transmitted are not complied with and the money has not
yet been forwarded or transmitted you have a right to a refund
of your money."

BMExpress
also sends Telegrams and Postal letters to the "Receiver"
for him to be informed of his remittance. Also, BMExpress
staffs make phone calls to the " Receiver" as long
as "Sender" indicates the telephone number of the
"Receiver" in his application.
LIMITATION
OF LIABILITY
IN
NO EVENT SHALL BMEXPRESS BE LIABLE FOR DAMAGES FOR DELAY,
NON DELIVERY, NON PAYMENT OR UNDER PAYMENT OF THIS MONEY REMITTANCE,
OR ANY SUPPLEMENTAL MESSAGE, WHETHER CAUSED BY NEGLIGENCE
ON THE PART OF ITS EMPLOYEES OR AGENTS OR OTHERWISE, BEYOND
THE SUM OF $500 (in addition to refunding the principal amount
of the Money Remittance and the fees), unless the Sender has
obtained a higher liability limit by calling the telephone
number set out at the bottom of this form and paying an additional
charge therefor. IN NO EVENT WILL BMEXPRESS BE LIABLE FOR
ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
THESE CONDITIONS CANNOT BE CHANGED OR SUPPLEMENTED ORALLY.
